Carefully, Inc. (“Carefully”, “we” or “us”) is committed to protecting and respecting your privacy as outlined in this policy (“Privacy Policy”). This Privacy Policy describes what kinds of data we may collect, how we collect it, how we use it, with whom we may share it, and what rights you have concerning it (the “Information”). This Privacy Policy is incorporated by reference into the Terms of Service of our website (https://www.carefullyapp.com), any subsequent or replacement site, (together referred to as the “Site”) and our mobile application (the “App”). We encourage you to become familiar with the terms and conditions of both this Privacy Policy and the Terms of Service. By accessing and using the Site and/or the App, you agree that you have read and understand this Privacy Policy and you accept and consent to the privacy practices (and any uses and disclosures of Information) that are described in this Privacy Policy.

What Information Do We Collect?

Certain aspects of the Site and the App may allow you to submit Information to us or to request Information from us. For example, if you create a member profile, you will be required to provide us with certain Information. The Information that you provide may include personal or individually identifiable information, including but not limited to; your name, email address, mailing address, telephone number, information about your children (including their name, birthday, allergies, doctor/emergency contact) and other Information. You should be mindful of the Information that you choose to provide to us, and you agree that any Information that you do provide is complete, truthful, and accurate.

You may also send messages to members of your groups, City Hub and others through the Site and the App. You are responsible for obtaining all necessary or appropriate consent and authorization to share as you designate any Information that you provide or make available, whether on or through your account, your groups or city hub, on the Site and the App. Furthermore, you agree to respect the privacy and rights of others.

In addition to the Information described above, we may also collect certain identifying Information from or about you in connection with your use of the Site and the App. For example, we may retain the content of, and metadata concerning , any correspondence you may have with us or our representatives, regardless of the subject matter or the means of communication by which such correspondence is made. This Information helps us to improve our capabilities and services, as well as the Site, the App, and any content, materials, and opportunities that we feature or describe on the Site and the App, and to more effectively and efficiently respond to both current and future inquiries.

We may allow you to create a member profile and log in to the Services through a third party social media service, including Google, Facebook, Twitter or LinkedIn. If you register through a SNS, we may collect personal data that is already associated with your SNS account and you may have the option of sharing additional information from your SNS account.

While using the Services, we may collect, with your permission, information related to your location, information from your contact list or your device’s phone book and pictures and other information from device’s camera or photo library. We use this information to provide, improve and customize the Services. You can enable or disable access to this information at any time through your device settings.

We may also collect Information about you from other users of the Services, for example when Members invite their contacts to use the Services or join a specific group.

As with many other websites, the web servers used to operate the Site and the App may automatically collect certain Information pertaining to you and the equipment and communications method that you use to access the Internet, the Site, and the App. Without combining this data with other sources of Information, they do not readily or personally identify you. They may reveal things such as the Internet protocol (“IP”) address assigned to your computer, specific pages that you accessed on the Site and the App or immediately prior to visiting the Site and the App, and the length of time spent in a visit to the Site and the App. The purposes for which this Information is collected and used includes facilitating Site operation and system administration, generating aggregated statistical information that is not personally identifiable, monitoring and analyzing Site traffic and usage patterns, and improving content and content delivery with regard to the Site, the App, and the materials, opportunities, and services that we describe or make available on the Site and the App.

We may also use “cookies” (small text files stored on your computer) to help track and customize your access to and use of the Site and the App. Cookies store and retain information that helps us recognize you when you return to the Site and the App following a previous visit. Most popular Internet browser packages allow you to configure the browser so as not to accept cookies. However, setting your browser to reject cookies may, in certain instances, prevent you from taking full advantage of the Site and the App and the materials, products, and services that we make available on the Site and the App. (See Cookie Policy)

As provided in the Terms of Service, we may provide members the option to activate our Trust+ feature for their member profiles, through which members may request from third party service providers that a background check be run on themselves using information they provide to those third party service providers. Carefully may receive a copy of, or otherwise have access to, the results of any such background check in order to facilitate the Trust+ process. For purposes of completing the Trust+ process, Carefully may store information such as the name, date of birth, and state of location of the member completing the background check, but Carefully does not store any other Information contained in the background checks. Any such background checks will be subject to the terms we establish for such checks on the Site and App pages where they are requested or authorized, the terms of this Privacy Policy, and our Terms of Service.

How Do We Use The Information That We Collect?

We may use, disclose, and keep on file any Information that you submit or provide to us (or that you cause to be submitted or provided to us) through or in connection with the Site and the App, as reasonably necessary and appropriate for the purposes for which it was submitted. For example, if you create a member profile, we will use the Information that you provide to set up your profile or access to the Site and the App. If you request information or materials from us about our services, we may use the Information that you provide to contact you and to deliver the requested materials to you. However, except as specifically provided for in this Privacy Policy, we will not disclose, sell, lease, or license personally or individually identifiable Information about any individual for purposes other than that for which it was submitted.

With regard to other Information collected by or on the Site and the App, in addition to the uses mentioned or described above or otherwise described in our Terms of Service, we may use the Information that we collect to analyze and improve the content, features, materials, and opportunities that we make available on the Site and the App. We may also use the Information to notify you of changes made to the Site and the App or of new opportunities made available on or through the Site and the App, to evaluate your needs and customize the Site and the App content delivered to you according to those needs, to send you promotional materials, and for other legitimate and lawful business purposes. If you contact us for support or assistance in connection with using the Site and the App, we may use Information about you or your system for other purposes such as verifying whether your system meets the minimum requirements needed to use the Site and the App and any capabilities or functionality that we make available on the Site and the App. In addition, we may use Information that we collect or obtain about you, from time to time, to send you announcements, newsletters, and notices about our services, sponsors and partners. You may opt-out of receiving any or all of these email communications by following the unsubscribe link or contacting us.

We may aggregate and/or de-identify information collected by the Site, the Services, or via other means so that the information is not intended to identify you. Our use and disclosure of aggregated and/or de-identified information is not subject to any restrictions under this Privacy Policy, and we may disclose it to others without limitation for any purpose.

If you are a member opting into our Trust+ feature, you may share certain information with the third party service providers performing the background check, such as your name, date of birth, and the state where you are located. If you are a member authorizing a background check to be run on you as part of the Trust+ feature, the results of the check will be shared directly with the Carefully, but Carefully will not store the results of the background check; Carefully may only store your name and date of birth. If you are a member who has requested, and passed, a background check through Carefully’s Trust+ feature, then a Trust+ badge will be featured on your member profile on the Site and the App to confirm that you have completed that background check. Other members in your trusted network will be able to see the badge on your member profile, the date of the background check, and the legal name you used in the background check.

With Whom Do We Share Information That We Collect?

If you enter, upload, or post personal or health Information about yourself or your family, friends, or other loved ones into your account on the Site and the App for sharing with other designated members of your groups or city hub, we will make that Information available, through the capabilities of the Site and the App as you designate. By doing so, you agree that you have obtained all necessary and appropriate consent and authorization to share as you designate, any Information that you provide or make available on or through your account, groups or city hub on the Site and the App.

The Site and the App are designed and intended for use by users in the United States, Canada and other countries, however, Information provided for posting or making available on the Site and the App is stored in the United States. However, you acknowledge and understand that the Site and the App are available, via the Internet, throughout the world. By submitting or providing Information on or to the Site and the App, you agree to comply with all applicable laws, regulations, and policies of all relevant jurisdictions, including but not limited to, the European Union General Data Protection Regulation (“GDPR”). You represent and warrant that you have all necessary or appropriate consent of others to, any transmission of that Information across country boundaries, as necessary for the purposes for which the Information was submitted.

Certain social media networks may link-to the Services (e.g., Instagram, Facebook and/or LinkedIn). These social media networks maintain their own privacy policies and policies relating to data collection, retention and use, and to the extent that you elect to utilize the social media network linking within the Services, you acknowledge and agree to comply with any of these third party terms, in addition to acknowledging, that except where prohibited by law, Carefully is not liable or responsible for any use of the social media network that you elect to engage in. These social media networks may receive your data when you visit or use their services or through third parties they work with.

We will, in the course of conducting our business, and in addition to any other uses or disclosures mentioned above or otherwise described in our Privacy Policy, share certain individually-identifiable Information that we collect or that you submit to us, whether solicited or unsolicited, to the trusted business partners and service providers that we utilize in operating, maintaining, and further developing the Site and the App and in delivering the content, materials, opportunities, and services that we make available on or through the Site, the App, or otherwise as part of our business. Examples of such partners or service providers include web hosting providers, payment processors and email service providers. We share such Information only to the extent necessary and appropriate for the purposes for which the Information was collected or submitted (such as, for example, as necessary for purposes of communicating with you or fulfilling your requests for services, or for purposes of hosting the Site and the App), and we require our business partners and service providers to be subject to ongoing obligations of confidentiality.

We may also produce reports on Site and App traffic or usage patterns and share these reports with our business partners and others. The Information contained in these reports is anonymous and does not allow identification of any specific individual or entity. Similarly, we may from time to time share with third parties other aggregated information and data that do not identify any particular individual or entity. Other than as expressly provided in this Privacy Policy, any personal Information that we obtain through the Site and the App will not be shared with third parties in a manner that identifies or is attributable to any particular individual.

We may disclose Information (including personal and individually identifiable Information) about you or in connection with your use of the Site and the App if we become subject to a subpoena or court order, or if we are otherwise legally required to disclose such Information. We may also use and disclose Information about you or in connection with your use of the Site and the App to establish, exercise, or protect our legal rights, to enforce the Terms of Service (or any other agreements) and assert or defend against legal claims, or if we believe such disclosure is necessary to investigate, prevent, or take other action regarding actual or suspected illegal or fraudulent activities or potential threats to the physical safety or well-being of any person.

If you are a member who has requested, and passed, a background check through Carefully’s Trust+ feature, a Trust+ badge will be featured on your member profile on the Site and the App confirming that you have completed that background check.

As we continue to grow and develop our business, it is possible that our organizational structure may change, that we may merge or otherwise combine with another company, or that we, or portions of our business, may be acquired by another company. In the event of such a transaction, customer Information generally will likely be one of the transferred business assets and we may transfer Information to our successor entity. In no way, and under any theory of liability, in contract, tort, or otherwise, will Carefully be liable to you for misuse of Information by any third party.

Analytics

Google Analytics

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualise and personalise the ads of its own advertising network.

You can opt-out of having made your activity on the Service available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js and dc.js) from sharing information with Google Analytics about visits activity.

Data Controller for the Facebook Fan Page

  • The Company is the Data Controller of Your Personal Data collected while using the Service. As operator of the Facebook Fan Page https://www.facebook.com/carefullyapp, the Company and the operator of the social network Facebook are Joint Controllers.

Facebook Insights

  • We use the Facebook Insights function in connection with the operation of the Facebook Fan Page and on the basis of the GDPR, in order to obtain anonymized statistical data about Our users.

  • For this purpose, Facebook places a Cookie on the device of the user visiting Our Facebook Fan Page. Each Cookie contains a unique identifier code and remains active for a period of two years, except when it is deleted before the end of this period.

  • Facebook receives, records and processes the information stored in the Cookie, especially when the user visits the Facebook services, services that are provided by other members of the Facebook Fan Page and services by other companies that use Facebook services.

What Rights Do You Have?

When using the Site and the App, you choose what Information to enter, upload, or post into, and what messages to send through, your profile on the Site and the App and with whom such Information is to be shared.

You may also use the functionality of the Site and the App to update, maintain, and remove Information about yourself or your family, friends, and other loved ones that you have posted to your respective groups or city hub on the Site and the App, as well as personal or individually identifiable iInformation regarding themselves that is stored in their respective accounts.

Members must be at least 18 years old to register, set up and manage the accounts. If you are not 18 years old, you agree to not attempt to register, set up and manage account(s) for yourself and/or others. If you believe a person under the age of 18 is using managing their own or someone else’s account(s), please contact us at: care@carefullyapp.com.

Security

Carefully uses high-level security and encryption. We use a variety of technologies and procedures to help protect the security of your personal Information from unauthorized access, use, or disclosure. Carefully also maintains standard physical and electronic procedural safeguards that limit access to your personal Information to our employees (or people working on our behalf and under confidentiality agreements) who, through the course of standard business activities, need to access your personal Information. Your personal Information will be stored in a secure manner. Full access to the Site and the App is enabled only by usernames and passwords. You are fully and solely responsible for any and all use of the Site and the App App using your username and password. We reserve the right to revoke or deactivate your username and password at any time.

How Long Your Information Is Retained

We retain relevant Personally Identifiable Information related to your account and/or your relationship with us pursuant to applicable federal and state rules and regulations and so long as retaining said Personally Identifiable Information is necessary including, but not limited to, the duration of time that you utilize the Services, and a reasonable period after termination of any relationship. Information may persist in copies made for backup and business continuity purposes for additional time.

Children’s Privacy

We do not intentionally collect data from children under the age of 13. The Services is not directed to children under 13 and children under 13 should not use the Services. If we learn that we have inadvertently collected any such data, we will delete it as soon as possible.

Relatedly, certain aspects of the Site and the App may allow you to provide Information to Carefully about your children (such as their name, birthday, allergies, doctor/emergency contact). Because of this, the Children's Online Privacy Protection Act of 1998 and its rules (collectively, "COPPA") may require us to inform parents and legal guardians ("parents") about our practices for collecting, using, and disclosing personal Information from children under the age of 13 ("children"). COPPA may also require us to obtain verifiable consent from a child's parent for certain collection, use, and disclosure of the child's personal information; however, we do not intentionally collect data from children and the Services are not directed or intended for children. The only way Carefully collects Information concerning children is if you directly provide such Information to Carefully about your children. By providing such Information to Carefully, you consent to its collection, use, and disclosure as provided in this Privacy Policy and the Terms of Service.

If you provide Information to Carefully about your children, that Information is only used for:

  • Organizing care: your children’s Information will be visible to members in your trusted network when they view your profile. For members outside your trusted network, only the age of your children will be displayed if you have joined a public space and want to connect with other members in those spaces.

  • Improving Carefully: we may use this Information in the future to improve the Services offered by Carefully, including search results within your trusted network.

We do not share, sell, rent, or transfer children's Information to third parties. We may only disclose children’s Information If we are required to do so by law or legal process.

If you share Information about your children with Carefully, at any time, you may review the children’s Information maintained by us, require us to correct or delete the children’s Information, and/or refuse to permit us from further using the children’s Information.

Changes to This Policy

Periodically, we may update our privacy practices and this Privacy Policy due to changes in our business or services and/or legal or regulatory requirements.
